Hire Terms & Conditions
These conditions apply to every hire of plant and equipment from SRB Group of Companies Pty Ltd T/AS PSG Plant Hire ("PSG", "we", "us"). By placing a booking, signing a hire agreement or taking delivery of equipment, you ("the Customer") accept these conditions.
1. The hire
- Equipment remains the property of PSG at all times. Hire gives you a right to use the equipment for the hire period only.
- The hire period starts when the equipment leaves our yard (or is delivered to site) and ends when it is returned to our yard or collected by us in the condition required by clause 5.
- A day rate covers up to 24 hours and up to 8 machine hours where the item is metered. A week rate covers 7 days and up to 40 machine hours. Excess hours may be charged pro rata.
2. Rates, payment and bond
- Rates are as published on psgplanthire.com.au at the time of booking, or as quoted in writing. Published rates are Perth Metro; Karratha and regional hires are quoted per job. All rates include GST unless stated otherwise.
- Fuel, delivery, damage waiver (where taken) and consumables are additional unless the quote states otherwise. Equipment leaves the yard fuelled and must be returned fuelled or a refuelling charge applies.
- We may require a bond or pre-authorisation before release of equipment. Bonds are refunded within 5 business days of return, less any amounts owing under these conditions.
- Account customers must pay within the terms shown on their credit agreement. Overdue amounts may accrue interest at 2% per month and reasonable collection costs.
3. Bookings, cancellation and availability
- A website booking request is an offer to hire. The hire is confirmed only when we accept it (by email, phone or SMS).
- Cancellations are handled under our Refund Policy.
- If equipment becomes unavailable through breakdown or late return by another customer, we will offer the nearest substitute or a full refund of amounts paid. That is the limit of our liability for unavailability.
4. Delivery, site access and unloading
- Delivery and collection are charged by distance and quoted at booking. You must ensure safe, lawful access for our float or truck, including firm ground, adequate clearance and any permits the site requires.
- Waiting time, failed deliveries caused by access problems, and site-directed delays may be charged at our standard cartage rates.
5. Your obligations
- Use the equipment only for its intended purpose, within its rated capacity, and in accordance with the manufacturer's instructions and any induction we provide.
- Ensure every operator is competent and holds any licence, ticket or verification of competency required by law or by the site. An LF high-risk work licence is mandatory for forklifts; appropriate driver's licence classes are mandatory for trucks.
- Complete daily pre-start checks, maintain fluid levels, and stop using the equipment immediately if a fault develops. Report faults to us on 1300 12 HIRE or 0408 378 275 (24 hours). Do not attempt repairs without our authorisation.
- Obtain a Before You Dig Australia (BYDA) search before any excavation and locate all services. Damage to underground or overhead services is your responsibility.
- Secure the equipment against theft, weather and vandalism while it is in your possession, and do not remove it from the nominated site or sub-hire it without our written consent.
- Return the equipment clean. Cleaning beyond normal wear may be charged at cost.
6. Damage, loss and breakdowns
- You are responsible for loss of or damage to the equipment from when it leaves our yard until it is returned or collected, excluding fair wear and tear and mechanical failure not caused by misuse.
- If the equipment is lost, stolen or damaged beyond economic repair, you are liable for its replacement value, plus loss of hire income at the applicable rate for up to 4 weeks while it is replaced.
- Where offered and taken, our damage waiver reduces your liability for accidental damage to the excess stated on the hire agreement. The waiver does not cover theft, overload, misuse, operation in water, tyre or track damage, underground or overhead service strikes, or use in breach of these conditions.
- Breakdowns not caused by misuse: we will repair, replace or, at our option, credit hire charges for the downtime. We are not liable for any other cost the breakdown causes you.
7. Work health and safety
- Equipment is supplied maintained, serviced and, where applicable, tested and tagged. You are responsible for its safe use on site, including exclusion zones, spotters, PPE and compliance with the WA Work Health and Safety Act 2020 and site rules.
8. Liability
- Nothing in these conditions excludes rights under the Australian Consumer Law that cannot be excluded. Where we may limit liability, our liability for any claim is limited, at our option, to resupply of the hire or the cost of resupply.
- To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, delay costs or liquidated damages under your contracts.
- You indemnify us against claims arising from your use of the equipment, except to the extent caused by our negligence.
9. Title, PPSR and default
- These conditions create a security interest in the equipment for the purposes of the Personal Property Securities Act 2009 (Cth). We may register that interest.
- If you fail to pay, breach these conditions or become insolvent, we may terminate the hire and enter any site where the equipment is located, at reasonable times and with reasonable notice where required, to recover it.
10. General
- These conditions are governed by the laws of Western Australia. The courts of Western Australia have jurisdiction.
- If any clause is unenforceable it is severed; the rest remain in force. These conditions, the hire agreement and any written quote are the entire agreement.
